CLEVELAND, Ohio -- An arbitrator has ruled that former Cleveland right-hander Trevor Bauer will be reinstated immediately after serving 194 games of the 324-game suspension MLB handed down for violations of the league’s domestic violence, sexual assault and child abuse policy.

Bauer is still under contract to the Dodgers. They have 14 days to decide if they will add him to their 40-man roster. Bauer’s three-year $102 million contract with Los Angeles expires after the 2023 season.

MLB issued a statement following the arbitrator’s decision which said in part, “While we believe a longer suspension was warranted, MLB will abide by the neutral arbitrator’s decision, which upholds baseball’s longest-ever active player suspension for sexual assault or domestic violence.”

Bauer’s agent Rachel Luba, along with attorneys Jon Fetterolf and Shawn Holley, issued this statement on Twitter: “While we are pleased that Mr. Bauer has been reinstated immediately, we disagree that any discipline should have been imposed. Mr. Bauer looks forward to his return to the field, where his goal remains to help his team win a World Series.”

The decision by arbtrator Martin F. Scheinman ruled that Bauer will not be paid for the 144 games he was suspended for during the 2022 season. He will also not be paid for the first 50 games of the 2023 season (March 30, 2023 to May 23, 2023).

Here is MLB’s full statement: “Today, the neutral arbitrator selected by MLB and the MLBPA affirmed that Trevor Bauer violated Major League Baseball’s Joint Domestic Violence, Sexual Assault and Child Abuse Policy.

“After an exhaustive review of the available evidence the neutral arbitrator upheld an unpaid suspension of 194 games. As part of the decision, the arbitrator reinstated Mr. Bauer effectively immediately, with a loss of pay covering the 144 games he was suspended during the 2022 season. In addition, the arbitrator docked Bauer’s salary for the first 50 games of the 2023 season (i.e., the period covering March 30, 2023 to May 23, 2023). While we believe a longer suspension was warranted, MLB will abide by the neutral arbitrator’s decision, which upholds baseball’s longest-ever active player suspension for sexual assault or domestic violence.

“We understand this process was difficult for the witnesses involved and we thank them for their participation. Due to the collectively bargained confidentiality provisions of the joint program, we are unable to provide further details at this time.”

Bauer, 32 in January, has not pitched in a big league game since June 28, 2021. He was placed on admininstrative leave in July of 2021 after a San Diego woman accused him of sexual abuse. Bauer denied the accusation, saying the sex was consensual.

He stayed on adminitrative leave until MLB suspended him for two years on April 29, 2022.

When Bauer, a Cy Young winner with Cincinnati in 2020, was suspended, he said he planned to appeal. The appeal started on May 23 and covered the better part of seven months before a decision was rendered Thursday.

When Bauer’s accuser requested a restraining order against him, a Los Angeles Superior Court judge denied it. In February of 2022, the Los Angeles District Attorney’s Office said it would not pursue a criminal case against Bauer.

MLB, however, initiated its own 10-month investigation and suspended Bauer.

Besides the San Diego woman, the Washington Post reported that two Ohio women raised similar complaints against Bauer when he played for the Reds and Cleveland. Bauer denied all accusations.

Bauer was the first player to appeal a suspension regarding MLB’s sexual assault policy. In the other cases, which ranged from 15- to 162-game suspensions, the players reached an agreement with MLB before the suspension was announced.

Cleveland acquired Bauer from Arizona after he debuted with the Diamondbacks in 2012. He pitched for Cleveland from 2013 until he was traded to the Reds at the deadline in 2019. Bauer went 67-53 with a 3.89 ERA in 180 games, including 170 starts for Cleveland.

Bauer’s best season in Cleveland was 2017 when he went 17-9 with a 4.19 ERA in 28 games, including 27 starts. He struck out 196 and walked 60 in 176 1/3 innings.

Under terms of his original contract with the Dodgers, Bauer would have made $32 million in 2023. Not getting paid for the first 50 games of the upcoming season will take a $9.46 million bite out of that amount should the Dodgers add him to their 40-man roster.

The suspension, in total, cost Bauer $37.5 million.
